The Case in Hon’ble CAT Guwahati postponed to 17th Aug 2012 on medical grounds of the applicants. its learned that the BSNL counsel does not pressed hard at vacating the stay. In addition, to the existing stay orders from different Hon’ble CAT’s; it’s reliably learnt that the Hon’ble CAT Hyderabad also gave absolute stay on the promotions based on the LDCE. According to our information currently 13 cases are filed against the LDCE Promotions in Various CAT’s now personnel section of BSNL Corporate Office is in full swing  to make promotion to the SDE (T) under the seniority cum fitness (67% Quota).

From this entire episode we can infer that LDCE qualified candidates are not doing enough, the failed candidates (Mostly Promoted) are displaying their skill and vigor to prevent our career growth by all means but we the qualified remain silent accepting everything as our fate. If a failed candidates is displaying such vigor and energy to defend his failure how much a successful candidate should reveal his energy and strength for his career progression.

We should aspire to succeed in our mission not remain silent. If situation warrants actions do not hesitate.  it may be noted, efforts of our legal team through court cases prevented such moves from management for more than two years despite our legal team does not receive the support from many quarters yet we sustained and remain determined in all circumstances. Most of the direct recruits are not aware of their rights and remain mute spectators for events happening around. Its time to react and fulfill our mission rather hoping things will happen on its own please stress your representatives to devise a strategy to overcome this hurdles.

If leagal team was so committed then why did not you engage an advocate at Guwhatti. BSNL's advocate's & BSNL Management's commitment is well known. Engaging a mere junior advocate would have resulted in vacating the stay. Almost 2400 members of the AIGETOA are on the verge of getting their first promotion through so called first fast track promotion chance. Why association including the legal team is remaining as a mute spectator. If Association is not capable of coordinating at least engaging an advocate in CATs why should we come to a platform of such associations. At least in Kerala we have engaged some advocates in such case ( by all LDCE successful candidates irrespective of association) and avoided a absolute stay. In Kerala CAT’s interim order is purely linked to Guawhati stay only. If the Guawhati stay vacates it Kerala CAT’s stay also goes. We are ready to support for a central level movement to defend LDCE cases in CATs.

pls tell the way to our CS of our aigetoa...that how to handle the case...because legal affairs issue r not known by everybody....every pass canidate r going to help in any way...but take the leadership & find out the solution...

Engaging an advocate is not the problem, but payment for the legal services is a stumbling block. We should hail AIGETOA team especially TN guys for having shown the fighting spirit. GE-DR-JTOs irrespective of their caste, creed and association alignment should financially and personally support such a venture which will be a turn out to be a huge stepping stone in your career.

Can this association tell whether the cases filed after declaratio of result is by DRJTO or DOT personnel. If you see all the cases filed after declaration of result is by DRJTO only... association is playing double game with DRJTO by showing sympathy at the same time giving support to failed jto's. I am very much appreciated that at least other union is tried to conduct DPC and give some promotion to other JTOs(irrespective of DR or DOT recruited)..

Cadidates Failed bcoz they have shown their skills in obstructing others..This shows their mentality..Dont worry!!! finally LDCE qualified will only win..

Don't Worry !! there are so many JTOs who have not joined on promotion given in mar'11. so they are now ready to go in court if further DPC takes place as their names is not their in current DPC list and they havnt refused last promotion..so all future promotions are in the hands of legal department. Be sure that there wont be any further DPC until the last DPC case is cleared legally. So all DRs who failed/passed NJOY in JTO cadre till retirement.!!!

AIGETOA legal team should concentrate on DoPT case in addition to LDCE case. If we fail DoPT case again no GE can hope to become SDE in near future. For SNEA they need this LDCE to be stopped and implement seiority cum fitness promotion withou following DoPT, i think presently they are in a strong position to win both the cases unless we do something to prevent. DoPT case should be given prime importance as SNEA will be trying to promote their candidates first and they will occupy core positions nearer to their home post which they where holdng for their entire life in BSNL, even if we win the LDCE case and got our members promoted by the time there will not be any vacant SDE post in major cities making most of our members would be force to accept transfer to tenure and remote stations. Presently everyone is quarreling , please forget your differences , AIGETOA is very good and trustable platform it needs support to get these both cases settled. as a junior member i m giving full support to AIGETOA.

We had offered financial support to Legal team in this regard . So fund was not the issue.

At any cost DoPT case should be taken by AIGETOA, if we delay this time, no GE JTO have to think of their promotions in near future.

Funding for seniority cum fitness should be provided to AIGETOA legal team by all the AIGETOA members. If we loose the case, our future is in dark, those who want to stay in this company should fight this time.
This time it should not be TN team alone, Each circle AIGETOA unit can file separate cases at respective High courts to get favourable orders. AIGETOA might be having atleast 400 members in each circle.If of this around 300 people contribute atleast 1000 rs, 3,00,000 which is well enough.AIGETOA must not waste time in filing the case as now 3months are over from seniority list is published.
